1. About these terms

These terms and conditions ("terms") apply to your use of LekkePomp: the website at lekkepomp.co.za and the LekkePomp apps for iOS and Android (together, "LekkePomp" or "the service").

LekkePomp is operated by LekkeLet (Pty) Ltd (registration number 2025/621954/07), a company registered in South Africa and based in Jeffreys Bay. "We", "us" and "our" refer to LekkeLet (Pty) Ltd, and "you" refers to anyone who uses LekkePomp.

By using LekkePomp, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the service.

LekkePomp is free to use and you do not need an account.

2. Important: prices are reported by users

Please read this section carefully. It limits our liability to you.

  • Every price on LekkePomp is submitted by members of the public. We do not receive prices from fuel stations or oil companies, and we do not check each price before it is shown.
  • A price may be wrong, out of date, linked to the wrong station or fuel grade, or deliberately false.
  • The date and colour next to a price show when it was last reported or confirmed. They do not mean the price is still correct.
  • Always confirm the price at the pump before you fill up. The price shown at the station is the price you pay.
  • LekkePomp is a guide only. Where you buy fuel is your decision, made at your own risk.

To the extent the law allows, we are not responsible for any loss, cost or inconvenience that results from relying on information on LekkePomp, for example paying more than the price shown or making a wasted trip. Section 8 sets out the full limitation of liability.

3. Using LekkePomp

  • Never use LekkePomp while driving. Check or add prices only when you are safely parked, or ask a passenger. You must obey the road traffic laws, including the rules on using a phone while driving.
  • Follow each station's safety rules on the forecourt, including any rules on using your phone at the pump.
  • Use LekkePomp lawfully and for your own personal use.
  • Do not interfere with the service, overload it, test its security, or try to get around our measures against spam and false submissions.
  • Do not scrape, copy or extract prices or other data using bots or other automated means without our written permission.
  • If you are under 18, use LekkePomp only with the permission of a parent or guardian.

Distances, station locations and map information are approximate.

4. Adding prices and other submissions

When you add or confirm a price, report a problem or send us anything else ("submissions"), you confirm that:

  • the price is one you saw yourself, at that station, for that fuel type and grade, on that day;
  • your submission is honest and accurate to the best of your knowledge;
  • you are not submitting false, misleading or test prices, or prices meant to promote or harm a station or brand; and
  • your submission contains no personal information (yours or anyone else's), offensive content or anything unlawful.

Moderation. We may review, edit, hide, reject or delete any submission at any time without notice. We may block devices or IP addresses that we believe are used for spam, abuse or false submissions. We are not obliged to check every submission and cannot guarantee that false ones will be caught.

Use of your submissions. Submissions are public and are not paid for. You give us a free, permanent, worldwide, non-exclusive and transferable right to use, store, display, copy, adapt, combine and publish your submissions, including as part of aggregated or anonymised price data that we may share or license to others. Price reports may be kept indefinitely, as described in our Privacy Policy.

5. Fuel stations and brands

LekkePomp is independent. We are not affiliated with, endorsed by or sponsored by any fuel station, retailer or oil company unless we say so clearly.

Station and brand names belong to their owners and are used only to identify stations. Station details, such as name, location and fuels sold, may be incomplete or wrong.

If you own or manage a station and believe information about it is wrong, please contact us through Report a problem. We will review it and correct or remove information where appropriate. We do not remove accurate price reports at a station's request.

6. Privacy and location

Our Privacy Policy explains how we collect and use information in line with the Protection of Personal Information Act 4 of 2013 (POPIA).

Access to your location is optional. If you allow it, we use it to centre the map, show nearby stations and identify the station when you add a price. You can switch it off at any time in your device or browser settings, although some features will then not work.

7. Intellectual property and third-party services

The LekkePomp name, logo, design, software and the compiled database of prices belong to LekkeLet (Pty) Ltd or its licensors. You may use LekkePomp for your own personal, non-commercial purposes. You may not copy, republish or sell the prices or database, in whole or in substantial part, without our written permission.

LekkePomp uses third-party services, including map data from OpenStreetMap contributors. Those services have their own terms, and we are not responsible for them or for any external websites we link to.

If you downloaded the app from the Apple App Store or Google Play, that store's terms also apply. Apple and Google are not parties to these terms and are not responsible for LekkePomp or its support.

8. Availability and liability

8.1 Availability. LekkePomp is a free service provided "as is" and "as available". We may change, suspend or stop any part of it at any time. We do not promise that it will always be available, error-free or free of harmful code.

8.2 Limitation of liability. To the fullest extent allowed by law, including the Consumer Protection Act 68 of 2008 where it applies:

  • we give no warranty, express or implied, that any price or other information on LekkePomp is accurate, complete or current;
  • we are not liable for any direct, indirect or consequential loss or damage, including loss of money, time, fuel or profit, that arises from:
    • using, or being unable to use, LekkePomp;
    • relying on any price or other information on LekkePomp; or
    • submissions made by other users; and
  • if we are found liable despite the above, our total liability to you is limited to R500.

8.3 What we do not exclude. Nothing in these terms excludes or limits our liability for gross negligence, intentional wrongdoing, or anything else that cannot lawfully be excluded or limited. Nothing in these terms takes away any right you have under the Consumer Protection Act that cannot be waived.

8.4 Indemnity. You indemnify us against any claim, loss or cost (including reasonable legal costs) that arises from a submission you made, your breach of these terms, or your unlawful use of LekkePomp.

9. General

9.1 Changes to these terms. We may update these terms from time to time. The current version will always be available at lekkepomp.co.za/terms, with the date of the last update shown at the top. If a change is significant, we will show a notice in the app or on the website. By continuing to use LekkePomp after a change, you accept the updated terms.

9.2 Governing law. These terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute.

9.3 Electronic communication. You agree that these terms, and any notices we send electronically, are valid as electronic communications under the Electronic Communications and Transactions Act 25 of 2002.

9.4 Other terms. These terms and our Privacy Policy are the full agreement between you and us about LekkePomp. If any part of these terms is found to be invalid, the rest remains in force. If we do not enforce a right immediately, we have not given it up.
